Discussion and consideration of Site Development Plan (revised Grading Plan) for removal of fill placed in the CH2MHill Regulatory Floodplain in violation of Title 23, Section 23.40.080 and Fox Lake future commercial/office site. The property is located north of Fox Lake Lane and west of I-35 Frontage Road. Requested by Jim Tapp.
Jim Tapp on the behalf of Fox Lake Investments, LLC is requesting approval to remove the fill placed in the Regulatory Floodplain and to clear and grade additional area outside of the floodplain. This is being brought to the Stormwater Drainage Advisory Board (SWAB) for consideration due to additional clearing and grading outside the floodplain..
Immediate upon approval.
If this item is approved, it is staff recommendation that the following items are a part of the approval:
No live matured trees in the regulatory floodplain shall be removed without the City Engineers approval.
All brush and tree debris piles need to remove and disposed of in accordance with all federal, state and local requirements.
All dirt and rock piles west of the existing pond needs to be removed.
All dirt removed from the site will need to be disposed of in accordance with all federal, state and local requirements.
Applicant will supply staff their OKR10 Stormwater Quality Permit, Stormwater Pollution Prevention Plan and Notice of Intent prior to commencing work.
